Developer asked pay compensation for delay in work


A real estate developer is ordered to pay compensation by TDCDRF for delay in work

31mumbai-realty2Thane: A developer is directed by Thane District Consumer Disputes Redressal Forum (TDCDRF) to pay compensation of Rs 1.45 lakh for deficiency in services and also ordered him to complete the redevelopment work at Rabodi locality of Thane city, which was initated in 2004, within three months.

President of the forum Umesh Jhavalikar and member N D Kadam have recently given the order.

The complainant Yusuf Hussain Miya Shaikh co-owned the property, along with the respondent Moiddin Badgujar, who is the proprietor of the Royal Developers and Construction.

According to the complaint by Shaikh, Badgujar had undertaken the task of redevelopment of the property, but did not give possession of the same on time. Also, the construction was not completed and he did not get the occupation certificate and also did not form a society as agreed.

The complainant also said that the developer had given an area short by 72 sq ft of area violating the agreement.

The complainant claimed a compensation of Rs 2.88 lakh as compensation for the short area, besides 18 per cent interest per annum on the delayed possession. He also demanded Rs one lakh towards mental torture and Rs 10,000 towards legal expenses.

The respondent argued that as some of the members of the building were his relatives, he could not form the society.

The forum said the developer should complete all the incomplete work within three months, or else pay a penalty of Rs 500 per day.

IT also directed him to form a co-operative society within four months.
