HC quashes case against college students
Madurai: The Madras High Court has quashed a criminal case booked against a group of college students for allegedly kidnapping a fellow student belonging to a rival group and inflicting cut injuries following a memorandum of compromise between the petitioner and the complainant.
Justice C.T. Selvam of the Madurai Bench, allowing the petition filed by one of the accused, quashed the First Information Report (FIR),registered by police at Nachiyarkoil in Thanjavur district not only with respect to the petitioner but all the accused in the case.
Police had booked the case in 2010 under IPC Sections 148 (rioting armed with deadly weapons), 294b (uttering obscene words), 324 (causing hurt voluntarily with dangerous weapons) and 363 (punishment for kidnapping).
“The petitioner in the present case is the first accused. Owing to differences between students, one group has set upon members of the other, carried away one in a car, caused a cut injury on the right ring finger of such person and released him under threat.”
The action of the students was “not befitting the student community.” But it should be seen as one arising out of the indiscretion of the youth,the judge said.
Now all of them were beyond college-going age “and are to step into their various walks of life,” the judge said, quashing the
